LOS ANGELES (Reuters) - A Chicago man who bought Microsoft Corp.’s new Xbox 360 has sued the world’s largest software maker, saying the new video game console has a design flaw that causes it to overheat and freeze up.
The proposed class action claims that in Microsoft’s bid to gain share in the $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing next-generation machines from Sony Corp and Nintendo Co Ltd. that it sold a “defectively designed” product.
Robert Byers, who brought the suit, said the power supply and central processing unit in the Xbox 360 overheat, affecting heat-sensitive chips and causing the console to lock up.
Microsoft spokeswoman Molly O’Donnell on Monday said the company does not comment on pending litigation.
Complaints about the problem surfaced quickly on gaming enthusiast Web sites after the Xbox 360 debuted on November 22.
Console owners reported that some systems had crashed during regular use as well as during online game play using the Xbox Live service. Problems included screens going black and the appearance of a variety of error messages.
At the time O’Donnell told Reuters: “We have received a few isolated reports of consoles not working as expected.”
She declined to say how many reports Microsoft had received and said that calls reporting the issue to the company represented a “very, very small fraction” of units sold.
The lawsuit, filed on Friday in federal court in Illinois, seeks unspecified damages and litigation-related expenses, as well as the replacement or recall of Xbox 360 game consoles.

Dave Chappelle is back on Comedy Central — well, kind of. The wildly popular comedian, who last spring walked off his show just weeks before its season premiere, will be on view in four episodes’ worth of sketches he filmed before his startling exit, the cable channel announced Monday.
The four half-hours of “Chappelle’s Show” will premiere in weekly showings next April, May or June, the network said.
A 2 1/2-minute preview of this never-before-seen footage will be included in “Comedy Central’s Last Laugh ‘05″ special, which premieres Sunday, 9 p.m. EST. - Yahoo News

The wife of pitcher Kris Benson criticized the Mets for attempting to trade the right-hander in part because of her negotiations to pose nude for Playboy, the New York Daily News reported on its Web site on Monday.
“We would never, ever have signed with New York if they had said they were going to trade us,” Anna Benson told the paper. “I was Miss [Politically Correct] for the Mets the entire time I was there.
“I have no deal with Playboy,” she added.
Before the 2005 season began, the Mets signed Kris Benson to a three-year, $22.5 million deal after acquiring him from the Pirates in July 2004. - ESPN
Hey I don’t blame her. Nothing like playing and living in New York. Going to Baltimore would suck! But still you can’t blast the Mets. They did provide her with that special Box Seats area with a King Size bed and satin sheets for her and Kris’s after game “party”….at her request.
Its kinda corny, but i had to post something….more like a music video showing off their clothes. It’ll only be showing Dec.1 till Dec. 7th…I don’t think anyone will notice anyway. They should have used a more upbeat song.
